Constitution of the Dal Khalsa

 ARTICLE 1

Name: The name of the organization will be “Dal Khalsa” (hereinafter referred to as the Organization).

 ARTICLE 2
Offices: The Head office of the Organization shall be located at Amritsar and sub-offices in different parts of the Punjab and the world.

 ARTICLE 3
Introduction: As per the concept of Piri-Miri, Dal Khalsa will be a socio-religio-political organization of the Sikh nation. Dal Khalsa will be committed to uphold the honour and historically-recognized unique identity of the Sikh people.

 ARTICLE 4
  1. Primary Mission
    The primary goal of the Dal Khalsa will be to establish self-rule for Sikhs. Dal Khalsa will abide by and utilize all international laws, rules and norms to accomplish its mission.
  2. Aims and Objectives
    1. To provide principled direction to Sikh politics.
    2. To promote respect, observance and commitment for human rights as enshrined in the Sikh faith as well in various international arrangements.
    3. To ensure that South Asia is a nuclear-free zone.
    4. To strengthen the economy of the Punjab through active association with world economy and to nurture and develop the Sikh Diaspora worldwide.
    5. To revamp the education system in accordance with Sikh traditions and to cater to the needs of modern society.

 ARTICLE 5
Organizational Structure of the Organization:
The organizational structure of the Dal Khalsa shall consist of the executive committee, the working committee and an advisory board.

(A)    Executive Committee

  1. The Executive Committee will not have more than 14 members besides the President.
    The executive committee will have following office-bearers:
    1. Vice-President
    2. Secretary General
    3. Secretary, Religious Affairs
    4. Secretary, Economic Affairs
    5. Secretary, Organizational Affairs
    6. Secretary, Information and Public Relations
    7. Secretary, Political Affairs
    8. Secretary, Legal Affairs
    9. Secretary, Human Rights
    10. Secretary, Social and Cultural Affairs
    11. Secretary, Education and Sports Affairs
    12. Secretary, International Affairs
  2. The Executive Committee shall manage and control all affairs of the party.
  3. All decisions of the Executive Committee will be passed with a two-third majority.
  4. The President of the Organization will chair the meetings of the executive committee. In the absence of the President, either the acting-president or vice-president will chair the meetings of the Executive Committee.

(B)    Advisory Board

A 5-member Advisory board will advise the executive committee on all matters referred to the board by the Executive committee.
(C)    Working Committee
A 40 Member Working Committee will play the role of a link between the Executive Committee and the members of the Organization.

 ARTICLE 6  

  1. Conditions for membership:
    Any person can become a member of the Organization:
    1. who unflinchingly adheres to the Shabad Guru concept and keeps faith only in Sri Guru Granth Sahib.
    2. who complies with the definition of a Sikh as specified in the Code of Conduct, approved by Sri Akal Takht Sahib and published by Shiromani Gurdwara Parbandhak Committee, Sri Amritsar.
    3. who subscribes to the aims and objectives of the Dal Khalsa
  2. Conditions for membership of the executive committee:
    To become a member of the Executive Committee, any member
    1. who partakes Khande Dee Phaul (Amrit)
    2. who is a member of the Organization for the last two years.
  3. Membership Fees and Donations:
    A member will pay annual membership fee of Rs. Ten only. However, the membership is subject to the discretion of the executive committee. The Organization shall receive donations from all quarters, but no donation shall be accepted from undisclosed sources. An official receipt will be issued towards every aid received. Accounts will be audited every year and subject to inspection of the General House of the Delegates.

 ARTICLE 7

  1. Meetings:
    1. The members of the Executive Committee shall meet once every month.
    2. The members of the working committee shall meet once every three months.
    3. The delegates of the party shall meet once a year.
    4. Special Session - A special session of the Organization will be held, if one-third members of Executive Committee so decide and make a request to the President to convene such a Special Session for discussing the agenda as specified. A notice of atleast 72 hours is a must to convene such a session.
  2. Quorum
    In each of the above meetings, the quorum shall be one-third of the total strength of the membership of the concerned committee.

 ARTICLE 8

  1. Delegates:
    A delegate shall be the representative of members of a particular area. For every 30 members, there shall be one delegate. In case the total membership from a particular area is less than 30, then one delegate shall be nominated for the total membership of the area. The total number of delegates shall be determined by the executive committee of the Party after every two years on the basis of the membership of the Organization.
  2. Election of the President
    The members of a particular area will elect the delegates who in their turn will then select the President of the Organization for a maximum period of 2 years. The President will then appoint the team of office-bearers and members of the executive committee, working committee and advisory board. The President shall be elected for a maximum of two terms in a row. The President shall be selected only from amongst the members of the executive committee.
  3. Removal of the President
    The President can be removed/replaced by the members of the executive committee with the approval of a two-third majority.
  4. Resignation of the President
    Only the Executive committee will be authorized to accept or reject the resignation of the President.

 ARTICLE 9
Suspension and Expulsion of members:
A member shall cease to be a member of Dal Khalsa:

  1. when he dies.
  2. when he is incapable of discharging his duties due to temporary or permanent physical or mental disability.
  3. when he has been involved in a case of moral turpitude.
  4. when the members of the executive committee loose faith in the integrity of the member.
  5. when a member breaches discipline of the Organization.
  6. Breach of discipline includes:
    1. acting or carrying on propaganda against any programme or decision of the Organization.
    2. opposing the official candidate of the Organization in any election.
    3. carrying out activities detrimental to the progress of the Organization.
    4. collecting funds for the Organization without authorization.

In cases 1 to 4, no show cause notice is required. A formal resolution of the executive is necessary to suspend a member. In case no. 5, a show cause notice of 4 weeks shall be issued to the member giving details of his anti-party activities and after consideration of his reply, the executive shall summon him before taking any action against such member.

 ARTICLE 10
Amendment:
The Constitution can be amended and altered only by the Executive Committee with the approval of a two-third majority. The changes made by the Executive Committee shall be placed before the immediate next session of the delegates of the Organization for adoption and ratification.

 ARTICLE 11
Units of the Party:
The Dal Khalsa will set up units in various parts of the world. Each unit will operate as a branch of the Organization to fulfill the aims and objectives of the Dal Khalsa. Every branch of the Organization will be authorized to set up sub-offices in various parts of the world.
